Terms and Conditions – Fencing Quincy , MA

Introduction

These terms and conditions apply to the provision of products and services by Fencing Quincy MA to clients. By requesting or purchasing our products and services, you agree to be bound by these terms.

Definitions

“Company” refers to Fencing Quincy MA, registered address 123 Main St, Quincy, MA 02108.

“Client” refers to the person or organization purchasing or requesting products or services from the Company.

“Products” refers to fencing materials sold by the Company, including but not limited to wood, vinyl, aluminum, chain link, and related components.

“Services” refers to fencing installation, repair, demolition, and other services provided by the Company.

Quotes and Pricing

The Company will provide a quote for products and services after assessing the Client’s requirements on-site. Quotes are valid for 30 days. Pricing may be subject to change prior to a deposit being paid.

The Company reserves the right to adjust pricing after the site inspection if the scope of work changes or unforeseen issues arise. Any changes will be discussed with the Client before proceeding.

Quotes include only the products and services itemized. Additional charges may apply if the scope expands after acceptance.

Deposits and Payments

A 40% deposit is required to secure the quoted products and services. The remaining balance is due upon completion of the project.

Accepted payment methods include check, cash, Visa, MasterCard, Discover, and American Express credit cards. A convenience fee of 3% will be applied to credit card payments over $1000.

For projects exceeding $10,000 in value, progress payments may be agreed upon by separate arrangement.

Scheduling

The Company will coordinate with the Client to schedule suitable installation dates after a deposit is received. We will make reasonable efforts to accommodate the Client’s availability.

Requested installation dates are subject to change depending on weather, staffing, and other factors. The Company will promptly notify the Client of any revisions to the schedule.

Permits and Approvals

The Client is responsible for obtaining any necessary permits, HOA approvals, or other permissions required for the fencing project prior to installation. The Company can provide relevant details about the project to aid in approval.

Additional charges may apply if the Company is required to revise or delay the project due to permitting issues from the Client.

Fence Location and Property Lines

The Company will make every effort to place fencing as closely to indicated property lines as possible. However, we do not perform property surveys. Any disputes over property lines or fence encroachment are the Client’s responsibility to resolve.

The Client must clearly mark or disclose any underground lines, utilities, or other obstructions on the installation site. The Company is not liable for any unmarked obstructions.

Materials and Products

The Company will make every effort to source and install the agreed upon fencing materials and products listed in the Client quote and contract.

If certain products become unavailable prior to installation due to shortages, changes in manufacturer availability, or other factors, the Company will provide suitable alternate materials of comparable quality and pricing, or credit any difference in product pricing.

The Client must inspect and approve all materials upon delivery before installation commences. Once accepted, the Company is not liable for defects or damage to delivered materials while in the Client’s possession.

Site Conditions and Preparation

The Client is responsible for ensuring the installation site is properly prepared before the project start date. This includes moving or removing any obstructions in the project area.

If site conditions on arrival do not permit work to be performed safely and efficiently, the Company reserves the right to delay or reschedule the project until resolved. Site preparation work rendered may incur additional fees.

Any alterations made to the site after the Company leaves at the end of the day may incur additional fees if it impedes the next stage of installation.

Cleanup and Disposal

The Company will make reasonable efforts to keep the project site clean during the installation process, including containment of dust and debris.

All packaging materials will be removed from the Client’s property and disposed of properly. Old fencing slated for replacement will be dismantled and removed unless otherwise specified. Additional disposal fees may apply for difficult materials.

Any damage outside of the project area caused by the Company will be repaired or compensation provided to the Client.

Limited Warranty

The Company provides a 1-year limited warranty on our installation services. This warrants the workmanship against defects in labor that compromise the integrity or functionality of installed fencing and gates.

The warranty does not apply to normal wear-and-tear, natural weathering, improper maintenance, abuse, or unapproved modifications made by parties other than the Company.

Manufacturer warranties covering fence and gate components will be provided to the Client upon project completion when available.

Limitation of Liability

The Company is not liable for any indirect, incidental, or consequential damages arising from the project, including but not limited to loss of profits, loss of use, or property damage (other than the installed fencing).

The Company’s maximum liability is expressly limited to the total value of the quoted contract. This applies to damages of any kind, including bodily injury or death.

Indemnification

The Client agrees to indemnify and hold harmless the Company and its employees or agents from any damages, liabilities, claims, or expenses arising from:

• Personal injury or death of any person in the project area not directly caused by the Company’s negligence.
• Property damage not directly caused by the Company’s workmanship.
• Any disputes over property lines, encroachment, or regulatory issues.

Insurance

The Company maintains general commercial liability insurance and worker’s compensation policies to protect its interests. Clients may request proof of valid insurance certificates.

Clients are responsible for maintaining their own homeowner’s or other necessary insurance policies. The Company is not liable for damages that would be covered by the Client’s insurance policies.

Dispute Resolution

If any dispute arises from this agreement, the Client and Company agree to first make a good faith effort to resolve it through negotiations between appointed representatives.

If negotiations fail, the parties agree to explore non-binding mediation before pursuing formal litigation or arbitration remedies. All disputes will be governed by Massachusetts law.

Cancellation Policy

The Client may cancel the services in writing prior to the scheduled start date for a full refund of any deposit. Cancellations within 48 hours of the start date forfeit 50% of the deposit.

Once installation has commenced, the Client is responsible for paying the full contract price even if the project is canceled or abandoned prior to completion.

The Company reserves the right to delay, reschedule, or cancel the services due to circumstances beyond reasonable control, such as permits, weather, emergencies, or work stoppages. We will make reasonable efforts to accommodate the Client if cancellations occur.

Amendments

The Company reserves the right to amend these terms and conditions at any time. Revisions will take effect immediately when posted on our website or otherwise provided to the Client. Existing contracts and deposits will remain under the original accepted terms.

Entire Agreement

This document constitutes the entire agreement between the Client and the Company. No other written or verbal representations outside of an executed quote, contract, change order, or invoice are enforceable.

By submitting a deposit, the Client acknowledges complete understanding and acceptance of these terms and conditions in their entirety without modification. The agreement shall be governed under Massachusetts law.
